Terms and Conditions for Fleurs de Crème

Please read these Terms and Conditions (“Terms”) carefully. They govern your use of the https://fleursdecreme.com website (the “Service”) and the purchase of any products from Fleurs de Crème (“us”, “we”, or “our”).
1. Your Consent & Agreement
By placing an order through our Service, you agree to be bound by these Terms and Conditions and our Privacy Policy. Work on your custom order will only commence once payment has been received in full.
2. Florida Cottage Food Law Disclaimer
“Made in a cottage food operation that is not subject to Florida’s food safety regulations.” Our business is a registered Cottage Food Operation in Broward County, FL. Our kitchen is not inspected by the Department of Health. We are committed to the highest standards of cleanliness and safety in our preparation.
3. Pricing, Quotes & Payments
- Pricing: All prices are non-negotiable and are priced according to the specific design, size, and complexity of your order. We do not “price match.”
- Quotes: Following an inquiry, any price quote provided is valid for 7 days. Paying for your order secures this price. We reserve the right to adjust pricing in exceptional circumstances beyond our control (e.g., a sudden, significant increase in ingredient costs).
- Payment: Full payment via credit/debit card is required to secure your order and book your date.
- Securing Your Date: Your event date is not secured until you have paid in full. Following an inquiry, we will hold a potential date for 24 hours. After this time, the date becomes available to other customers.
4. Orders
- Lead Time: We require at least 3-5 days’ notice for most orders. It is advisable to book as far in advance as possible, particularly for weddings, holidays, and weekends.
- Short Notice Orders: Orders requested with less than 2 days’ notice will be considered based on availability and will be subject to a 15% rush fee.
- Right to Decline: We reserve the right to decline any order at our discretion.
5. Allergen Disclaimer & Ingredients
- Allergens: Our home kitchen processes common food allergens, including but not limited to milk, eggs, wheat, soy, peanuts, and tree nuts. We cannot guarantee any product is 100% free from allergens due to the risk of cross-contamination.
6. Design, Product Care & Quality
- Design Conditions: We aim to produce creations of the highest quality that meet your desires. However, as each item is handcrafted, we do not guarantee an exact replica of any design, including our own previous work. Slight variations in color, size, and design are to be expected.
- Staining: The vibrant buttercream colors may stain clothing and surfaces. Please handle with care.
7. Our All-Butter Buttercream & Product Care
At Fleurs de Crème, we are committed to using only the highest quality ingredients, including real butter in our signature buttercream. We do not use shortening or other artificial stabilizers. This dedication to quality means our buttercream is delicate and will melt in warm conditions.
- Storage: For the best flavor and texture, our products should be enjoyed at room temperature. Please store your order in a cool, dry, air-conditioned space away from direct sunlight.
- Serving Outdoors: If you plan to serve the product outdoors, we recommend refrigerating it beforehand. To ensure optimal texture, please allow it to sit at room temperature for up to 2 hours before your event.
- Your Responsibility: It is the client’s responsibility to handle and store the product with care. Fleurs de Crème is not liable for damage, melting, or changes in quality due to improper storage or exposure to warm environments after the product has been successfully delivered or collected.
8. Collection & Local Delivery
- Inspection: It is your duty to inspect the product upon collection or delivery to ensure it is in perfect condition and the order is complete.
- Collection: You will be given a specific time for collection. By accepting the product and removing it from our premises, you confirm it was received in perfect condition. We accept no liability for damage that occurs after collection.
- Delivery Responsibility: It is your responsibility to ensure that someone is available to receive your delivery during the agreed-upon time window. Fleurs de Crème is not responsible for the product’s condition, including melting or spoilage, if no one is available to accept the order.
- Failed Delivery: In the event no one is available, we will attempt to leave the order in the safest, most shaded spot possible and provide a photograph as proof of delivery. However, this action does not guarantee the product’s stability, and we are not liable for any damage or loss that occurs after it has been left.
- Transporting Your Order: We advise traveling with products on a flat, secure surface, such as the passenger-side footwell of your vehicle. We are not responsible for damage occurring during your transport.
9. Cancellations, Returns, and Refunds
- No Returns: Due to the perishable nature of our products, we do not accept returns.
- Cancellations: All payments are non-refundable.
- If you cancel 3 days or more before your scheduled collection/delivery date, you will receive a business credit for the full amount paid, valid for 180 days from the date of cancellation.
- If you cancel less than 3 days before your collection/delivery date, all monies paid will be retained, as preparation and supplies for your custom order will have already been committed.
- Refunds: Refunds are only issued in the rare event that we must cancel your order, or if our head artist determines, at her sole discretion, that a final product does not meet our internal standard for culinary excellence.
- Mistakes: Any order mistakes (wrong flavor, etc.) must be reported to us within 4 hours of receipt, with photographic evidence. We will work with you on a fair solution, such as a partial credit or replacement.
10. Photographs
We reserve the right to take and use photographs of all our creations for our website, social media, and other advertising purposes.
